1. Booking confirmation
An event is not confirmed until all of the following have occurred:
- Sophisticated Sips has accepted the event in writing;
- the client has signed or electronically accepted the event agreement, quote, invoice, booking form, or other written confirmation;
- the required reservation payment, deposit, retainer, or full payment has cleared; and
- any required event details have been provided by the client.
Until all confirmation steps are complete, Sophisticated Sips may release the date, time, staff, trailer, equipment, menu capacity, or other resources to another client.
2. Reservation payment and final balance
Unless Sophisticated Sips states otherwise in writing, a reservation payment equal to 50% of the quoted event total is due to hold the date. The remaining balance is due no later than 14 calendar days before the event.
Events booked 14 calendar days or fewer before the event date require payment in full at booking unless Sophisticated Sips agrees otherwise in writing.
Sophisticated Sips may pause planning, decline service, or release the date if required payments are not received on time.
3. Why cancellation charges apply
When a client books an event, Sophisticated Sips reserves time, staffing, trailer availability, equipment, menu capacity, preparation time, administrative time, travel planning, and the opportunity to accept other work. Actual losses from cancellation can be difficult to calculate in advance.
For that reason, the cancellation amounts below are agreed liquidated damages for the cancellation itself. They are intended to be a reasonable estimate of anticipated loss and not a penalty. They do not limit Sophisticated Sips from recovering separate amounts owed for services already performed, approved add-ons, overtime, damage, fraud, chargeback abuse, collection costs, or other losses not caused solely by the cancellation.
4. Client cancellation charges
If the client cancels a confirmed event for any reason other than a written exception approved by Sophisticated Sips, the following cancellation charges apply:
- More than 30 calendar days before the event: 50% of the total event price;
- 15 to 30 calendar days before the event: 75% of the total event price;
- 14 calendar days or fewer before the event: 100% of the total event price;
- no-show, denial of access, event-day cancellation, or failure to provide required site conditions: 100% of the total event price.
Amounts already paid may be applied toward the cancellation charge. If the amount already paid is less than the applicable cancellation charge, the remaining balance remains due.
5. Rescheduling
Sophisticated Sips may allow one reschedule if all of the following are true:
- the request is made in writing at least 21 calendar days before the event;
- Sophisticated Sips has availability on the requested new date and time;
- the new date is within six months of the original event date;
- the event location, scope, guest count, and service needs remain reasonably similar; and
- the client pays any increased costs and the rescheduling fee.
The rescheduling fee is 10% of the total event price, capped at $250, unless Sophisticated Sips waives it in writing.
A reschedule is not guaranteed. If Sophisticated Sips cannot accommodate the requested new date, the original cancellation policy applies.
6. Weather, safety, and site conditions
Sophisticated Sips may delay, modify, suspend, or stop service when weather, site access, electrical conditions, parking, ground conditions, crowd behavior, fire risk, law enforcement direction, venue rules, health requirements, or other circumstances make service unsafe, illegal, impractical, or likely to damage the trailer, equipment, staff, customers, or property.
The client is responsible for providing safe access, legal parking, any required permits, reasonable setup space, necessary utilities if agreed, and a service area suitable for the trailer and staff.
If Sophisticated Sips is ready and able to perform but cannot do so because of conditions within the client's responsibility, the event may be treated as a client cancellation and no refund will be owed.
7. Force majeure
Neither party is responsible for failure or delay caused by events beyond reasonable control, including severe weather, natural disasters, government orders, road closures, power outages, public emergencies, labor disruptions, illness, accidents, supply disruption, venue shutdowns, or other events that make performance impossible, illegal, or unsafe.
When a force majeure event occurs, Sophisticated Sips may first offer a reasonable reschedule or service modification. If performance cannot reasonably be rescheduled or modified, any refund will exclude completed custom work, special orders, nonrecoverable costs, third-party fees, administrative time, and other amounts already committed for the event.
8. Guest count, menu changes, and final details
Final guest count, menu selections, location, timing, utility requirements, and service details are due by the deadline stated in the quote or event agreement. If no deadline is stated, final details are due 14 calendar days before the event.
After the final deadline, the price will not be reduced because of lower attendance, reduced consumption, weather, shortened event time, menu preference, or unused capacity.
Sophisticated Sips may approve increases, add-ons, overtime, or changes in writing, subject to availability and additional charges.
9. Late start or shortened event
If the event starts late, access is delayed, guests arrive late, the venue changes timing, or the client shortens the event, Sophisticated Sips is not required to extend service time or reduce the price.
Any approved overtime or extended service must be approved by Sophisticated Sips and paid at the applicable rate.
10. No refunds after service begins
Once Sophisticated Sips begins setup, travel, or service for the event, refunds are not available except where required by law or expressly approved in writing by Sophisticated Sips.
No refund is owed for unused cups, unused ingredients, lower-than-expected attendance, guest preference, customer taste, lines caused by guest behavior, venue restrictions, event schedule changes, or circumstances outside Sophisticated Sips' control when Sophisticated Sips has substantially performed.
11. Company cancellation
If Sophisticated Sips cancels an event for a reason within its control and does not provide a reasonable substitute, reschedule, credit, or alternative service accepted by the client, Sophisticated Sips will refund amounts paid for unprovided services.
That refund is the client's sole monetary remedy to the fullest extent allowed by law. Sophisticated Sips is not responsible for indirect, incidental, special, consequential, emotional-distress, lost-profit, replacement-vendor, venue, travel, or other third-party damages.
12. Refund timing and method
Approved refunds are initiated within 10 business days after Sophisticated Sips confirms the refund in writing. Refunds are issued to the original payment method when reasonably possible.
Bank, card processor, payment platform, and third-party processing times are outside Sophisticated Sips' control. Disclosed third-party processing fees, payment platform fees, and nonrecoverable charges may be excluded from refunds unless applicable law requires otherwise.
13. Chargebacks and payment disputes
The client agrees to contact Sophisticated Sips first in good faith before initiating a chargeback or payment dispute, unless the client has a genuine legal basis to dispute an unauthorized or fraudulent charge.
If a client initiates a chargeback contrary to this policy or after receiving contracted services, Sophisticated Sips may provide the signed agreement, booking records, messages, invoices, proof of service, proof of costs, and this policy to the payment processor. The client remains responsible for amounts owed, chargeback fees, collection costs, and reasonable attorney fees where allowed by law.
14. Limitation of liability
To the fullest extent allowed by law, Sophisticated Sips' total liability for any claim related to an event is limited to the amount actually paid by the client for that event.
Sophisticated Sips is not liable for indirect, incidental, special, consequential, punitive, lost-profit, emotional-distress, replacement-vendor, venue, travel, or third-party damages.
Nothing in this policy limits liability that cannot legally be limited, including liability arising from gross negligence, willful misconduct, or other nonwaivable rights under applicable law.
15. Governing law and venue
This policy is governed by Florida law. Any dispute will be handled in the state or federal courts serving the Florida county where Sophisticated Sips maintains its principal office, unless applicable law requires a different venue.
16. Severability
If any part of this policy is found unenforceable, the remaining sections will remain in effect. Any unenforceable part will be modified only as much as necessary to make it enforceable and consistent with the original intent.
17. Required client acknowledgement
Before submitting a booking request or making a payment, the client must acknowledge:
"I have read and agree to the Sophisticated Sips Cancellation, Rescheduling, and Refund Policy. I understand that reservation payments, cancellation charges, rescheduling fees, weather and site-condition rules, and refund limits may apply."
